I watched a guy get sent home today. He was sent as a contracted forklift driver. A hospital was recieving a 2 ton multi million dollar piece of equipment, and it required a powerful forklift to move it.
The guy was forklift certified, but there was a problem: The guy was deaf.
The guy could not recieve audible instructions at all and the guy running the operation said "no way, that is a huge hazard to everyone."
Do you guys think it was the right thing to do?
Personally, I agree with him.

If being deaf was an issue he wouldn't have his licence.

So, no he shouldn't of been sent home. That would be classed as discrimation.

as well as receiving compensation.

He had an interview.

They knew he was deaf

He was Employed even though he was deaf.

When he received his certificate for his forklift
license he passed they knew he was bloody deaf.

I'm a little confused here.

He's a licensed fork lift driver, even though he is deaf. Well, you'd think he has a regular place of work where he operates the forklift all week long for his pay check.

Figuring its still early enough in the day.....why would he be sent home? Why wouldn't he just be sent back the where he normally works?


Also...in a case like this or even where he normally works, you'd think because he can't receive audio signals, then there would have to be someone with him, to give him hand signals, who is qualified to do this...meaning it would cost an employer two salaries to do the job of one person, actually producing work from a forklift. Its hard to fathom that an employer would lose money like this on a regular basis.

But, lets assume, that he works for a forklift driver for hire company and there is no regular place of work and this company just sends out drivers to various locations on request ....again there would have to be someone qualified to go with him to give him the hand signals...again costing the company two salaries, so how can this company compete with the prices of another company who can send out a driver who can do the work by himself requiring only one salary.?


Something is not adding up here and a job like this one...you'd think they'd send a driver who doesn't need an assistant to do the job.

Here's a question:

Picturing this scenario in my mind. I'd assume this two ton expensive equipment came out and simply had to be unloaded and set down somewhere, or on something with wheels so it can be taken from there and moved into the H.P. ..because you can't get a huge forklift and what it is carrying down the halls of a H.P..to where it needs to be set up.

So how can something be that simple "setting this down from the truck to a spot on the ground"...be such a hazard to so many people ????


Also, when a company delivers an expensive piece of equipment like this, especially sensitive Hospital Equipment....typically it comes out in a special deliver truck to keep it from bouncing around, where the driver of the truck operates the forklift, which is attached to the trailer he brought out the equipment on, because this is standard procedure in a case like this. A company that delivers such type of equipment would rather have the final set down of the sensitive equipment by the Deliverer, who they know is qualified to handle sensitive equipment like this.

Lucky he is a 'Contractor' not on salary.. hence your company doesn't have to use him, but if he can prove that he would not be doing the job, because he is deaf, even though he had a Ticket/Certified, he can sue the company big time.. 'Discrimination'

Was he told why he wasn't going to do the job? Most, if not all, of the instructions given to forklift drivers are given by signals, anyhow.

I was at the pool the other day and noticed a deaf family next to us. The mother came up to me and handed me her phone. She was asking to use some of our sunscreen for her son, since they ran out. I handed her ours.

The guy running the operation was in the wrong. If he was certified, and even if he only worked as a temp worker, he was fully qualified to do the job, whether or not he could hear any instructions.

Besides, like Ms. Champagne said, instructions are given by hand signals, anyway.

That boss was an idiot who probably had no idea how to run a crew.

Just how did he think the worker got his certification, anyway? Or did he think he just became deaf?

But the worker was only a temp, and the temp company can, if one is available, send someone else, the company the boss worked for might not be as responsible for having discriminated against him. But may be...either way, he set up his company for a potential law suit.

Can't imagine his company would be too pleased about that.

no, it is to save the company by certifying its employees.
depuy, a Johnson & Johnson company makes implants [knees-shoulders-hips-spinal-ect] and they designed a program to save the company from being sued and losing billions of dollars. they certify the employee in the area of parts inspector. so, if a part you inspected ended up in operation and the guy sues it is your job and less liability for the employer.

it is a rather genius idea and one that should create the environment for an employee to actually do their damn job right.

None of my stories are made up. This happened right in front of me.
The audible signals came in later. The object needed to be driven to another building in the hospital complex. Both visual and audible signals were used to warn of incoming traffic from people both in front and behind because the object partially blocked vision for the driver.
I walked with them with installation instructions once they got it moved.

I completely agree with what happened, but the guy will no doubt say there was discrimination based on his defect and sue and settle for a huge out of court settlement.

I've never heard of a forklift being able to handle two tons. Wouldn't they use a crane for something that heavy?

It was a really big fork lift with legs that could be deployed to stabalize it and the forklift blades were extendible. The blades were deployed over the top with a three section extender to reach into the truck.
At max extension, the back of the forklift came off the ground which is why the extending legs were used.
Once where it was needed to go, big a** wheels were attached to the machine move it within the building. That forklift was NOT in the building.
